Austin Neighborhood Profile - Clarksville

The West Austin area of Clarksville was originally a freedman's colony for slaves freed after the Civil War. Clarksville now has a very diverse population, and this diversity is reflected in the various nationalities of the residents. There is an excellent public grade school in Clarksville, named Mathews Elementary. Every fall, Mathews holds a carnival on the grounds, which includes the Clarksville Annual International Dinner and the Octoborama Festival, which is held at the end of October.

During Octoberama, local musicians, many of whom are the parents or relatives of Mathews School students, perform at the carnival. Also, most of the kids bring large quantities of food to be sold at the International Dinner, to reflect the cuisine of the countries of their origin. Since most of the University of Texas Division of Housing apartment complexes are located in the West Austin area, and the grade school children residing there with their parents attend Mathews, many ethnicities and heritages are represented at the dinner, including Chinese, Korean, Japanese, Mexican, and various African and other nationalities. While at the Octoberama Festival, you can hear local musicians, sample all kinds of homemade food, watch contests such as two-legged races and relay races, and enjoy juggling and face-painting, which all of the kids love. Right down the street from the school is another Austin legend, Nau's pharmacy, which has one of the oldest soda fountains in Austin. You can have eggs for breakfast or a shake after school at Nau's, and then head down to the 9th Street dog park.

There are many good restaurants in the Clarksville area, and this area is a short bus ride or long walk to Lady Bird Lake, and the jogging trails, or you can go downtown by bus or on the sidewalk, just a mile or so in the other direction. There are also a number of historic homes in the Clarksville area, including a home referred to by the children as "the Castle", since it looks just like a medieval castle, but which was originally a military college building. There is also a "Moonlight Tower", another local landmark, in the area of the Castle. Austin and Clarksville are home to many local politicians and well-known Austinites. Ann Richards was a regular at the drug store soda fountain, and most Hollywood celebrities visit the restaurants when in Austin.

The Johnson Creek Hike and Bike Trail skirts the western edge of Clarksville, and winds along under the Loop One freeway, also called the MoPac for the Missouri Pacific rail line which runs directly alongside the freeway. You can walk, ride a bike, or jog up and down the hike and bike trail, which crosses Johnson Creek in one place and begins at Austin High School, on the northern shore of Lady Bird Lake.

From the Austin High School access point to the trails, You can cross the lake, which is actually the Colorado River, and hike through Zilker Park or swim in Barton Springs, or go north, and once past Clarksville, you eventually wind up in the Brykerwoods area, if you go south you can head down to the Barton Hills and Travis Heights.

Clarksville is also home to various arts and crafts establishments, and the yearly Eeyore's Birthday Party Celebration, another fun local event, which is held in Pease Park, on the north-eastern perimeter of the Clarksville area. All in all, The Clarksviile area of Austin is truly a great place to live, whether you're raising a family, a student, retired, or any one of the varied lifestyles which flourish in Austin. Hyde Park - An Austin Original

This article discusses many of the positive attributes of the Hyde Park neighborhood in Austin, Texas.

Imagine a neighborhood of adorable medium houses seated comfortably on shady streets lined with trees. But then splash a rainbow across the entire area. That could get you close to what the Hyde Park neighborhood in central Austin is like. This old part of town has a lot of history, and was one of Austin's first developments north of the Capitol. Many of the houses are over fifty years old, but are lovingly cared for by tenants and successive owners, often with a heavy dose of their personality thrown in for good measure.

Spanning the area from Dean Keaton street in the south to around 45th street or so to the north, and from I-35 to the east and Guadalupe street to the west, Hyde Park is a fairly large neighborhood. As it is located comfortably between many of the major thoroughfares in Austin, Hyde Park has long been a staple area for college students at the University of Texas, which has contributed heavily to the area's looks and atmosphere. Many of the houses are painted exuberant colors with eye-catching designs and artistic sensibility, a legacy of many resident's desire to "keep Austin weird." This also contributes refreshing diversity when compared to the cookie-cutter houses that so many other neighborhoods primarily consist of.

The biggest advantage of owning a house over an apartment or condo is the lot on which it lies, and Hyde Park has this attribute in spades. While many of the houses are modest in size, with most in the 1-to-2 bedroom range, the expansive yards more than make up for it. With more privacy and more space, Hyde Park houses are cozy and comfortable. The larger back yards also lend themselves to Austin ingenuity, with expansions, garage apartments, and other conversions being common. This also contributes to the value of each house without changing its character.

And what character! Most of these houses were built in a time when different trends were popular, and these designs have often proven to endure to maintain their popularity in a way that more modern houses cannot. While most houses built in recent years have good design behind them, one often gets the impression that a house is devoid of personality and designed to be as inoffensive as possible. While this approach is safer for an architect, it makes houses like those in Hyde Park that much more desirable. Some features that were often viewed as necessary in years past have either become unfashionable or become viewed as excessive, such as high ceilings and large porches.

However, these aspects of houses are very important to many prospective homeowners. This is evident by the continued value of the neighborhood over many years. Many houses in Hyde Park have higher ceilings than newer houses, especially because many are one story. This contributes to a feeling of space that many newer homes lack. Hyde Park houses also often have a disproportionately large number of windows, which provide increased sunlight and adds to the increased sense of spaciousness. The characteristic large porches also make the homes seem cozier, more inviting, and help to connect neighbors. I personally think one of the best benefits to having a house over an apartment is having a large porch on which to relax, and this seems to be an attractive attribute to many potential homeowners as well. Why Economists Are Usually Wrong

Everyone loves to poke fun at economists. It's almost as enjoyable a pastime as poking fun at attorneys. You've heard the jokes: If you laid all the economists end to end they still couldn't reach a conclusion. And this oldie but goodie: Economics is the only field in which two people can get a Nobel Prize for saying exactly the opposite thing. Or the classic: Why did God create economists? In order to make weather forecasters look good. (1)

Of course, as a group, they do have a dismal record as forecasters so some of the jokes are, to a point, deserved. But why do economists have such a poor record with their prognostications? Are they simply less intelligent than the general public? Is the field of economics just a guessing game rather than a science? Or are other factors involved which tend to make most economists wrong most of the time?

For arguments sake, let's rule out the possibility that economists are less intelligent than everyone else. After all, have you seen the math you're forced to confront when you study economics at an advanced level? It strains credibility to think you're lacking at least more than the average brain power if you can come close to comprehending the math required to earn a graduate degree in economics.

Although economics may be more of a guessing game than a hard science since the vagaries of human nature play such a strong role in the economic arena, it also seems reasonable to assume there are other factors involved in the inability of economists to beat the average weatherman in accuracy. Let's consider two of those factors.

The first factor is a basic error on the part of economists. Economists tend to extrapolate current trends into the future so their forecasts tend to look a lot like the recent past and the present. They might look at GDP growth over the last 10 quarters, run a regression study on those numbers and come up with a formula that can forecast the GDP at points in the future. Only problem with that method is what happened in the past and what is happening now may or may not be indicative of what's going to happen in the future. As a matter of fact, by the time a trend is obvious, it is usually over. The economy may have been growing at an average annual rate of 3.26% per quarter, but now that that fact is accepted as the fate of the future it's unlikely the rate of growth will be maintained. You can pretty well count on this: Current trends won't be future trends.

So if current trends won't be future trends, why do economists tend to base their forecasts on what has been happening? The answer to that question brings us to the second reason economists tend to miss their predictions more frequently than they get it right.

A basic human tendency is to try to avoid looking foolish. If you forecast a recession with enough lead time so a business owner can take action and protect the business from the negative effects of the downturn, you're talking downturn when the only thing everyone else, including the business owner, sees is a boom. You look like a nut. You might be vindicated in the end if the recession becomes a reality but by then, with the short attention span of the general public, most people will have already forgotten your forecast. So if you stick your neck out and make a forecast which bucks popular opinion, you're laughed at for making such a nutty prediction and then forgotten even if you're eventually proven right. That provides little incentive for going against the popular opinion.

John Maynard Keynes, as brilliant an economist as any to ever walk this earth, had this to say about bankers back in the 1930's: "A "sound" banker, alas! is not one who foresees danger and avoids it, but one who, when he is ruined, is ruined in a conventional and orthodox way along with his fellows, so that no one can really blame him." It's the same situation with economists. To paraphrase Keynes: "A "sound" economist, alas! is not one who accurately foresees the future, but one who, when he is wrong, is wrong in a conventional and orthodox way along with his fellows, so that no one can really blame him."

Partners and Shareholder Litigation - Breach of Fiduciary Duties

Litigation between business owners is an area of law that has seen a rise in recent years. Many disputes can be found in state and federal courts which concern the rights and responsibilities of shareholders in their relations with each other. A fiduciary duty is a duty of the utmost importance--one of the highest standards of care imposed in our legal system--whereby one person is called upon to care for the property of another.

Co-owners of businesses, partnerships, corporations, limited liability companies, and the like, all owe a fiduciary duty to each other. These duties include:


  1. Investment of money, and guarding those investments.

  2. Acting for the benefit of the party.

  3. Disclosing material facts.

  4. Taking due care so as to avoid misleading clients.

Some of the examples of where fiduciary responsibility comes into play are are Mortgage Brokers, Corporate Board Members, Business Partners or Financial planners serving and acting as fiduciary. Fiduciaries are the people who have an authority or power to exercise a legal right on behalf of another.

In a typical partnership litigation case you will often observe that the cause of action is for breach of contract, fiduciary duty breach (where the partner has betrayed the plaintiff), misrepresentation or fraud (where the partner concealed or misrepresented a fact that was material) and account issues (where the co-owner stole and the amount of damage caused to the company).

If a party has made any misrepresentation or has concealed some material facts for which he had the knowledge and misrepresents and does not reveal this to other party, the fraud will be the perfect cause of action but the cause of action cannot be for the breach of fiduciary duties. Therefore, if you suspect or believe that you are a victim and there is breach of fiduciary duties then you need to immediately contact a professional lawyer.

In some of the cases, parties to the contract also define the standard of duty.

The following elements are required to build a proper case:


  • A legal relationship, or contract that imposes a fiduciary duty

  • Breach of the duty imposed by law

  • And the damage caused due to breach of the duty

The Burden of proof in a case like this lies on the plaintiff that the defendant had fiduciary duty towards the plaintiff and that the defendant has breached the duty. Additionally, the plaintiff also has to prove that the damage has been caused due to breach. Generally it's a question of fact and not of law whether any kind of duty contract is in existence or not. This means that it can be quite difficult to resolve such cases. The jury will have to hear the testimony and weigh credibility of both the parties to determine the case.

Running Out of Money on the Eve of Retirement

My Grandfather retired from Texaco back in the 1980's. He had a great life until his stock holdings and real estate investments took a turn for the worse. Sure he relied on professionals to manage his money but it seemed that they made out even if he didn't. Then you factor in health care costs and all of the rules changing on health care plans things started to go crazy. We'll at least they're in their upper 80's and the family is looking out for them.

That leads us to a much larger problem. Do you find yourself in your 40's, 50's or 60's and in a similar predicament? Here's the problem now; we are in a massive recession and not to be a dooms day type but things are going to get worse. You don't have to be an economics expert to understand that the fundamentals of the U.S. and even global economy are upside down. It seems that America doesn't really manufacture much anymore and most of the labor has been globalized. How are we going to make a living to fuel our consumer society. In my opinion those days are over.

So here you are laid off or sensing that you are next. Even worst you are in denial (no not the big river in Egypt), more like denying yourself the truth. You might be in the process of getting sold on some big voluntary exit from a corporation. Perhaps you are a business owner but you've found yourself in the wrong place at the wrong time. What do you do?

I can tell you what entrepreneurial types won't do. They're not going to spend 5 years looking for a job that doesn't exist. Did you know big corporations are responsible for 0% of net job gains in the last 10 years? This means that 100% of the net gain has come from small business and entrepreneurs. When are you going to stop driving around traffic aimlessly and come to grips with reality?

Here's the opportunity as my family sees it. There is a new economy emerging which sends labor to the lowest market via the internet. The technology is also replacing jobs but it's also providing unparalleled opportunity in global markets. If Mp3's become the technology that replaces cassette tapes or cd's then if you worked at the cassette factory you'd probably be out of a job. Conversely, if you trained yourself in the new technology you would probably earn more money. Hence if the cheapest labor is moving overseas you should get with people that can train you on how to leverage that for your business.

Do you believe in yourself enough to become self employed? If you do that's great because you will be positioning yourself in the new economy. Enhance your position with learning how to market on the internet and you can be well on your way to having a global business. If you deal in products or services you should find a niche that has acceptable competition.. If you really want to succeed information products with highly credible track records do exceedingly well because they have great margins. This is what we've been able to structure at Team Texas Global (TM) with patience of course.

I would be extremely skeptical of any internet marketing pitch that tells you that you can make an executive income without any investment at all. Most any business will need working capital for tools, advertising and contingency. The other extreme are these network marketing deals that make you believe that you can make a massive amount of money by networking with friends and family. Got news for you; that rarely works.

If you can't stomach the thought of getting another job at half the pay or throwing a huge sum of money at a franchise (always a risky proposition in a bad economy); then you might consider the internet.

Yes even us older folks can do it. You just need to learn the basics of it and be patient with it. You can also outsource certain task to some of those cheaper markets that we discussed. The Western world has always succeeded at advertising and marketing; today is no exception.

The thing that me and my friends love about this is that we can work at home. My kids even take an interest in it and thinking about our kids is a big priority. We run a family business from our laptop or any internet connection from around the world. We can outsource copy-writing, internet marketing but are reluctant to outsource customer service or sales. We like the system to do 90% of the selling since certain people in our family don't like to waste time with tire kickers.

We would get the Grandparents involved in the business but the entire family is helping them. Our main concern is for our children and their children. An Adventure On Cape Cod

If you are considering vacationing at Cape Cod, there are several things should know and be aware of. We speak from experience.

If you are coming to Cape Cod by air, rail, or bus, then you need to consider renting a car once you arrive in Massachusetts. Cape Cod is a long, long sand bar. There are many places to go, but to be flexible you need reliable transportation.

We flew into Boston's Logal Airport on an earlier flight than expected. We had a Buick Lucern reserved at Alamo. Alamo tried their darnedest to accommodate us. They offered us several choices. We decided on a Buick LaCrosse. Nothing against Alamo, but we were not happy with the LaCrosse and we love Buicks. The ride wasn't a Buick ride, the trunk was smaller than we are used to, and the tires or power steering made strange noises every time we turned left. Still, however the LaCrosse got us where we wanted to go with enough power and comfort.

The roads on Cape Cod are generally in good condition, but there is a lot of construction always going on. By state law any construction site must have a police officer and car with blinking lights onsite. Also, the problem with the freeway system on the Cape is that you really have very few landmarks to go by for directions. Scrub pines flank both sides of the highway. Usually you can't see beyond them, so this means you can only see down the road and gives you the feeling that you are driving down a trough. Direction is also a problem. For example, you may be on a freeway system that calls for you to be driving south, but you may be going west and then possibly even north. In addition, each town is usually broken down into East, West, North, South, and Port. For example you might have West Dennis and Dennisport, East and West Sandwich, Hyannis and Hyannisport . . . the names like that go on and on.

Cape Cod cottages usually have names. We stayed with Al Burrage (friend and guide), who has a home in West Seattle. He owns The Mainstay, which he rents out during the season. Also, cute names abound throughout Cape Cod and Massachusetts in general. The quainter, the better. You will see The Jolly Captain, Cranberry Real Estate, Ketch of the Day, Shiver Me Timbers, Sea Shell Gardens, Breezy Knoll.

Many cottages have updated fronts, but not neccesarily sides and backs. This is partially an attempt to preserve original shakes and boards, while presenting attractive fronts to visitors from the streets. So, you might see sides and backs needing lots of work, and at the same time you might see excellent sides and backs quite different from the front. For example, you might see clapboard siding on the front painted yellow, and cedar shakes on the sides with only natural preservative. It's just a local convention. Also, you are going to see a lot of shutters, but they are just like most places. They are for decoration only. They aren't really functional.

Local news as well as information on local attractions can be found in the Cape Cod Times, which is available at most grocery stores and convenience stores. There are also two great coupon books: The Cape Cod and The Original Cape Cod Fun Book. Both are FREE and can be found all over the cape.

You will hear the term saltbox house quite often. This confuses people because the house really has nothing to do with the term. The term saltbox is derived from the antique saltboxes that used to hang on kitchen walls. The term really refers to an addition built onto an existing house, but of course if the house is designed that way in the first place you could still refer to the saltbox design. The home of John Adams had a saltbox addition to it. The house of the left has a saltbox addition on its right side. The firewood structure in the right image is the basic saltbox "look", so anytime you see that basic look on a home, you are seeing a saltbox house.

I don't know if the bridge on the left is the Bass River Bridge, but it should be. We watched a fly fisherman there as he made cast after cast. Peg asked him if he had caught anything and he said, "Yes. I got five stripahs." The translation for that comment is that he had caught five "stripers" or rather five striped bass. He then landed one for us. It measured 21 inches. Seven below the minimum. A striped bass needs to be 28 inches to be legal. The fisherman released the bass back to the river. The New England and Boston accents make you listen more attentatively. Like some of the local names, they may seem quaint to visitors, but the locals just speak that way.

Arts and crafts florish on Cape Cod. There are artists that paint, weave, draw, sculpt, blow glass and more. A favorite of friend Al is Michael Magyar. Michael's Glass Studio On Cape Cod is a great place to observe the creative spirit at work. The town of Sandwich, Massachusetts, has been famous for over one hundred years for its "Sandwich glass". Michael's studio is located in East Sandwich. He creates new glass objects every day. When we shot the photo on the left, Michael was creating a clear version of the glasses in the photograph to the right.

Glass artist Michael Magyar has many beautiful glass art objects available for purchase in his gift shop above his hot shop studio. Michael is friendly and his wife runs the gift shop. Michael learned from the masters and has worked with Dale Chihuly. He received his Masters in Fine Arts from Tulane University. He has many glass art pieces hanging and setting around his yard. Michael brings a wealth of both practical and academic experience to his work. He welcomes visitors and is open year round.

Price and fancy surroundings are not always an indicator of great seafood. We found a small, fast-food looking establishment called Jerry's Seafood. The prices were very, very reasonable and the food tasted great. You ordered at the counter from Jerry. Jerry served you and you ate at the plain Jane tables in Jerry's dining room.

I liked the signs in Jerry's windows. One read "Caution/Steamers" and the other read "Danger/Lobsta" amusing us greatly for both the humor and the accent. I don't know about dinner, but I would certainly eat lunch at Jerry's again.

I ordered the lobster roll for lunch. It was served hot. It was the best I had while I was in Massachusetts . . . and the lowest priced. Peg had the smelt. Peg is a great cook and she had cooked smelt only a couple of week before eating at Jerry's. His smelt was as good as her smelt . . . maybe better. The six to eight inch fish of the trout family were golden brown and not overly crisp or overcooked. The white flesh was tender and tasted like . . . more. Great food at great prices. We enjoyed every bite.

You will find beautiful views of small harbors, bogs, inlets, and estuaries. Enjoy them and tell others about Cape Cod . . . We will.

Is the Wage Gap Still a Problem?

Activists first began raising awareness of pay inequalities decades ago. Due in part to their efforts, two pieces of legislation have been passed to address the issue of discriminatory wages. In 1963, the Equal Pay Act made it illegal for men and women who do essentially the same work to be paid different wages from one another. In 1964, Title VII of the Civil Rights Act prohibited wage discrimination on the basis of race, color, sex religion or natural origin. These laws can be difficult to enforce, however, because some forms of discrimination are so deeply engrained and rarely explicitly expressed.

Progress has been made since the 1960's. However, the statistics showing a narrowing of the wage gap may be a little misleading. The Institute for Women's Policy Research claims that the 15% narrowing of the gap since 1973 is actually mostly attributable to a decrease in men's wages, rather than an increase in women's wages. Obviously, this is not the kind of change that equality activists want to see.

Wage discrimination is often discussed in terms of gender, but race has always been another factor in this issue. The U.S. Census Bureau has published information about median annual earnings for men and women divided by race. In 2006, white women earned a median of $33,768 while Hispanic women earned a median of $25,198. During the same year, white men earned a median of $44,152 while Hispanic men earned a median of $29,061.

People who disagree with the need for pay equity often point out that men and women who work the same jobs earn the same wages. This fails to acknowledge that men and women often work in different fields, and that women-dominated fields generally pay less well than male dominated ones. Some people blame this on cultural attitudes that devalue jobs held by women. For example, teaching, nursing and caring for children are women-dominated fields and usually not high-paying.

Pay equity will not just help women and members of racial minorities. Men working in women-dominated fields, and white people working in minority-dominated fields, also suffer from wage inequality due to their work being undervalued. In addition, fair wages could help people - especially working mothers - lift themselves out of poverty and strengthen the economy. Most importantly, everyone benefits from living in a society where people are treated fairly and respectfully.

Austin Texas 2008 Economic Forecast

The economic outlook for Austin generally mirrors the Texas forecast: local job and population growth outperforms the national economy. The Texas Workforce Commission predicts 3.1% job growth, while local economist Angelos Angelou predicts 2.3%. The unemployment rate for December 2007 was estimated at 3.6%, down from 5.1% in the Austin area during October 2006.

Austin population growth is driven by the high quality of life in the region, with the area being ranked as the top destination for relocating singles and families by several publications. Also, MSN recently ranked Austin as "The Greenest City in America" , continuing a string of "best ofs" for the city. Located on the Interstate 35 Corridor, the city has grown in population the 3rd fastest in America this decade, with Ft. Worth first and San Antonio fourth, according to data from the U.S Census Bureau. Population growth of 42,000 is projected for 2008, down from a high of about 60,000 experienced in 2006, according to the Austin-American Statesman.

Demand in the local real estate market is down as compared to 2006 but is still positive, with generally more houses on the market. Angelou predicts that if local homebuilders react to negative national trends, housing starts in Austin will fall while the local market is still healthy and homes are still in demand, which would then create a low inventory of new homes for sale. The result, he predicts, would be an increase in demand for rental housing such as apartments and result in a spike in rental prices.

Another indicator of the local real estate market is how much work property inspectors are doing, since their work is usually in demand when real property changes hands. According to my survey of inspectors, most say their number of inspections has dropped more than 50% since September 2007. Many did say, however, that the drop could be seasonal and that demand for their service should increase by May 2008.

Most job growth should appear in Austin's traditional strong areas, like government, education, and health services. As the state capital and seat of Travis County, local, state, and federal government employs more than 150,000 workers, and that's expected to increase, according to Texas A & M's Real Estate Center. As an education hub, with the University of Texas and more than 20 other colleges within 30 miles, and several large public school districts, Austin will need more education workers. The "Live Music Capital of the World" continues to employ many in the leisure and hospitality industry, and large healthcare employers like Seton and St. David's are expected to add workers.

With the quality of life high and the population continuing to increase, Austin should see positive job growth through 2009.

Avoiding the Estate Tax

Benjamin Franklin has been famously quoted as saying: "In this world, nothing is certain but death and taxes." In many ways, the federal estate tax is a vivid illustration of Franklin's somewhat pessimistic statement. Simply put, the estate tax is a tax which is assessed against the total value of a deceased person's estate.

Currently, the estate tax stands at a whopping 45% - this means that nearly half of a decedent's estate, minus exemptions, will be taken by the Internal Revenue Service. It's no surprise that many people are interested in avoiding estate taxes as much as possible. The good news is that there are several perfectly legal ways to do so by using some creative estate planning in conjunction with the exemptions set by the government itself.

Estate Tax Exemptions

Under IRS statutes, there are three main exemptions to the estate tax. To begin with, each estate is allowed a $2 million exemption on virtually all assets and property. This means that any estate with a value lower than $2 million pays no taxes, while an estate worth, say, $5 million, would only be subject to taxes on $3 million. This makes a huge difference in the total amount of taxes your estate is forced to pay. In addition, under the current laws, this standard exemption is scheduled to increase from $2 million today to $3.5 million in 2009. The bad news? The law is expected to change in 2010, reducing the exemption to a paltry (by comparison) $1 million.

Second, a tax exemption is granted to the estate in the amount of any property, assets, or cash passing from the deceased to his or her spouse. Therefore, if a husband dies and leaves his entire estate to his wife, no estate tax will be due. Furthermore, a similar exemption is granted for any donations made to a qualified charity organization. In other words - leave your estate to your spouse or a charity, and estate taxes are avoided.

One important fact to note is that the standard $2 million exemption and the spouse and charity exemptions are not mutually exclusive; that is, an estate can take advantage of all three, if planned correctly. For example, the husband from our previous example could choose to only pass $3 million on to his wife, and put the remaining $2 million into a trust fund. How much estate tax is owed? None, because the first $3 million claims the spouse exemption, while the remaining $2 million can pass under the standard exemption. Such an arrangement allows much more flexibility in estate planning - good news for us all.
